Terms of Service

1. Acceptance of Terms
By booking a vehicle transport with Baier Transport LLC ("Baier Transport," "we," "us," or "our"), you ("Customer," "you," or "your") agree to be bound by these Terms of Service. If you do not agree to these terms, do not use our services. These terms apply to all vehicle transport, storage, and detailing services provided by Baier Transport.
2. Service Description
Baier Transport provides vehicle transport services including open carrier transport, enclosed carrier transport, motorcycle shipping, seasonal snowbird transport, vehicle storage, and auto detailing. We transport vehicles throughout the continental United States using our own fleet and, in some cases, trusted carrier partners operating under our quality standards.
Transport timelines provided at booking are estimates based on route distance, current demand, and weather conditions. While we make every reasonable effort to meet estimated delivery windows, exact delivery dates are not guaranteed. Delays caused by weather, road conditions, mechanical issues, or circumstances beyond our control do not constitute a breach of these terms.
3. Booking and Reservations
A transport booking is confirmed when we accept your reservation and receive the required deposit. Booking confirmation will be sent via email and includes the estimated pickup date, delivery window, transport type, and total price.
You are responsible for providing accurate vehicle information (year, make, model, condition, modifications) and accurate pickup and delivery addresses. Failure to provide accurate information may result in delays, additional charges, or cancellation.
4. Cancellation Policy
Cancellations made more than 48 hours before the scheduled pickup date will receive a full refund of any deposit paid. Cancellations made within 48 hours of the scheduled pickup are subject to a cancellation fee, which will be communicated at the time of booking.
If a vehicle is not available for pickup at the scheduled time and location without prior notice to Baier Transport, a dry-run fee may be assessed to cover the cost of dispatching a carrier to the pickup location.
5. Vehicle Condition and Inspection
Baier Transport conducts a thorough vehicle condition inspection at both pickup and delivery. The inspection documents existing damage, mechanical condition, and vehicle accessories. Both the driver and the customer (or authorized representative) will sign the Bill of Lading, which serves as the official record of vehicle condition.
It is the Customer's responsibility to note any discrepancies on the Bill of Lading at the time of delivery. Claims for damage not documented on the delivery inspection must be reported within 24 hours of delivery.
6. Customer Responsibilities
Before transport, the Customer agrees to:
- Remove all personal belongings and valuables from the vehicle (limited trunk items up to 100 lbs may be permitted but are not covered by cargo insurance)
- Ensure the vehicle has no more than a quarter tank of fuel
- Disable any aftermarket alarm systems
- Ensure tires are properly inflated and the vehicle is in a condition suitable for loading and unloading
- Provide all necessary keys, key fobs, and access devices
- Disclose any mechanical issues, modifications, or non-standard features that may affect loading or transport
- Ensure the pickup and delivery locations are accessible by a standard car carrier truck
7. Liability and Limitations
Baier Transport maintains comprehensive cargo insurance covering vehicles in our possession during transport. Our liability for damage to your vehicle is limited to the terms of our cargo insurance policy. A copy of our insurance certificate is available upon request.
Baier Transport is not liable for:
- Personal items left in the vehicle during transport
- Pre-existing damage documented on the pickup inspection report
- Mechanical or electrical failures that occur during transport but are unrelated to the transport process
- Damage caused by acts of God, including but not limited to severe weather, hail, flooding, or natural disasters
- Delays caused by weather, road conditions, traffic, mechanical breakdowns, government restrictions, or other circumstances beyond our reasonable control
8. Insurance
All vehicles transported by Baier Transport are covered under our cargo insurance policy from the time of pickup to the time of delivery. Our insurance covers physical damage to the vehicle caused during the transport process.
The Customer's personal auto insurance remains the primary coverage for the vehicle. We recommend maintaining comprehensive coverage on your vehicle throughout the transport period. In the event of a claim, our cargo insurance functions as secondary coverage.
9. Payment Terms
Transport pricing is quoted based on the specific details of your shipment, including route distance, vehicle type, transport method, and seasonal demand. The quoted price is binding once a booking is confirmed unless additional services are requested or the vehicle details provided at booking are inaccurate.
We accept payment by credit card (Visa, Mastercard, American Express, Discover), debit card, and bank transfer (ACH). A deposit may be required at booking, with the remaining balance due upon delivery unless alternative payment arrangements are agreed upon in writing.
Outstanding balances not paid within 30 days of delivery are subject to a late fee of 1.5% per month. Baier Transport reserves the right to retain possession of a vehicle until all outstanding charges are paid in full.
10. Dispute Resolution
In the event of a dispute arising from or related to these Terms of Service or our transport services, both parties agree to first attempt to resolve the matter through good-faith negotiation. If the dispute cannot be resolved through negotiation within 30 days, either party may pursue mediation or binding arbitration in the State of New Hampshire.
These Terms of Service are governed by and construed in accordance with the laws of the State of New Hampshire, without regard to conflict of law principles. Any legal action arising from these terms must be filed in the state or federal courts located in Rockingham County, New Hampshire.
11. Indemnification
The Customer agrees to indemnify and hold harmless Baier Transport LLC, its officers, employees, and agents from any claims, damages, losses, or expenses (including reasonable attorney fees) arising from the Customer's breach of these terms, provision of inaccurate information, or negligent or wrongful acts.
12. Modifications to Terms
Baier Transport reserves the right to modify these Terms of Service at any time. Updated terms will be posted on our website with a revised effective date. Continued use of our services after changes are posted constitutes acceptance of the revised terms. We encourage you to review these terms periodically.
13. Severability
If any provision of these Terms of Service is found to be invalid or unenforceable by a court of competent jurisdiction, the remaining provisions will continue in full force and effect.
